Privacy Policy

GuardPost, a brand of The Lifeguard Company, LLC

Last updated: September 1, 2026

This Privacy Policy ("Policy") describes how The Lifeguard Company, LLC, a California limited liability company doing business as "GuardPost" ("Company," "we," "us"), collects, uses, and discloses information in connection with the GuardPost website and mobile application through which independent lifeguards and lifeguard instructors ("Contractors") may be discovered by individuals, event hosts, productions, and municipalities ("Customers") (together, the "Platform"). This Policy applies to Contractors, Customers, and municipality users of the Platform (each, a "User"). It is incorporated by reference into our Terms of Service, Independent Contractor Agreement, and Municipality Subscription and Listing Agreement.

1. Information We Collect

1.1 Information Contractors Provide. When creating and maintaining a profile, Contractors may provide: name, contact information, photo, bio, service radius, hourly rate, availability, and lifeguard and/or lifeguard-instructor certification documentation submitted for verification. Contractors may also provide proof of liability insurance and information necessary to complete a background check, in each case where submitted to qualify for a trust-tier badge, and where applicable under Company's then-current policies.

1.2 Information Customers Provide. When creating an account, searching for Contractors, or completing a booking, Customers may provide: name, contact information, zip code or location, event or training details, and messages exchanged with Contractors through the Platform.

1.3 Information Municipalities Provide. Municipality users may provide: point-of-contact information, facility information, and staffing or training needs posted to their listing.

1.4 Information Collected Automatically. We may automatically collect device information, IP address, browser type, usage data (such as pages viewed and searches performed), and approximate location derived from a zip code or device settings.

1.5 Payment Information. If Company processes any payment (e.g., subscription or verification fees), payment card information is collected and processed by a third-party payment processor; Company does not store full payment card numbers on its own systems.

1.6 Cookies and Tracking Technologies. We and our service providers use cookies and similar tracking technologies to operate and improve the Platform. These fall into three categories: Essential cookies (required for the Platform to function, such as maintaining your session and login state); Analytics cookies (help us understand how the Platform is used so we can improve it); and Advertising cookies (used to measure and, where enabled, personalize marketing). You can manage your preferences for Analytics and Advertising cookies at any time through the cookie preference tool available on the Platform; Essential cookies cannot be disabled because they are necessary for the Platform to operate.

1.6(a) Do Not Track. Some browsers offer a "Do Not Track" signal. Because there is no common industry standard for how to interpret such signals, the Platform does not currently respond to browser Do Not Track signals.

2. How We Use Information

  • To operate the Platform, including displaying Contractor profiles to Customers by location and enabling in-app messaging
  • To review and verify Contractor certification documentation, proof of insurance, and, if applicable, background check results
  • To calculate and display search rankings and trust-tier badges, including verification status, insurance and background-check status, activity status, and review scores
  • To process fees owed to Company, including contact fees, verification fees, and municipality subscription fees
  • To send account, transactional, and policy-related communications, including activity reminders described in our Terms
  • To investigate ranking or review appeals submitted by Contractors
  • To monitor and review messages exchanged through the Platform's messaging system for trust-and-safety purposes, including detecting fraud, harassment, or violations of our policies
  • To maintain the safety, security, and integrity of the Platform, including detecting fraud or fraudulent certification, insurance, or background-check documents
  • To comply with legal obligations and enforce our agreements

3. How We Share Information

3.1 Between Users. A Contractor's profile information (excluding certain private account details) is visible to Customers and municipalities who search the Platform. Messages sent through the Platform are shared with the recipient User, and Company personnel may also access and review message content for customer support, trust-and-safety, and policy-enforcement purposes as described in Section 2. Reviews submitted by a Customer may be displayed publicly on a Contractor's profile.

3.2 Service Providers. We may share information with third-party service providers who perform functions on our behalf, such as payment processing, certification or background-check verification, insurance partners (e.g., for on-demand contractor insurance offerings), hosting, analytics, and customer support.

3.3 Legal and Safety. We may disclose information if required by law, subpoena, or legal process, or if we believe disclosure is necessary to protect the safety of any person, investigate fraud, or enforce our agreements.

3.4 Business Transfers. Information may be disclosed or transferred in connection with a merger, acquisition, financing, or sale of all or part of Company's business.

3.5 No Sale of Personal Information for Cross-Context Advertising. Company does not sell personal information for cross-context behavioral advertising, and does not "share" personal information as those terms are defined under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

4. Certification, Insurance, and Background Check Data

Certification documents, proof-of-insurance submissions, and, if applicable, background check results are used solely to determine and display verification and trust-tier status and are handled with additional care given their sensitivity. We retain this documentation for as long as needed to maintain your verification or trust-tier status on the Platform, and for a reasonable period afterward to comply with legal obligations and resolve disputes, after which it is securely deleted, consistent with Section 5.

5. Data Retention

We retain information for as long as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements.

6. Your Choices and Rights

6.1 Account Information. Users may access, update, or request deletion of certain account information through the Platform or by contacting us.

6.2 State Privacy Rights. Depending on your state of residence, you may have additional rights regarding your personal information, such as the right to know, delete, or correct personal information, and the right to opt out of certain uses, under laws such as the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). To exercise these rights, contact us using the information in Section 11.

6.3 Communications. Users may opt out of non-essential communications, such as activity reminders, through account settings, subject to Users continuing to receive transactional or legally required communications.

6.4 Appeals. If we decline a rights request, in whole or in part, you may appeal the decision by contacting us using the information in Section 11 and referencing your original request. We will respond to your appeal within the time required by applicable law.

6.5 Authorized Agents. You may designate an authorized agent to submit a rights request on your behalf under applicable state privacy law. We may require the agent to provide proof of your written authorization and may also require you to verify your own identity directly with us.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information collected through the Platform, including certification documents, insurance documents, and payment information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children's Privacy

The Platform is not directed to individuals under 18, and we do not knowingly collect personal information from children.

9. International Users

The Platform is intended for use within the United States.

10. Changes to This Policy

We may update this Policy from time to time by posting a revised version on the Platform. Material changes will be communicated as required by applicable law.
